Privacy Policy
1. Overview
Bkd Local, LLC (“Bkd Local,” “we,” “us,” or “our”) operates a marketplace connecting customers with independent artisan bakers. This Privacy Policy describes what personal information we collect, how we use it, who we share it with, and your rights regarding your data. By using the Platform you agree to the practices described in this Policy.
2. Information We Collect
From Bakers: When a Baker registers, we collect their name, business name, email address, phone number, city and state, pickup address, Instagram handle, profile photo, bio, menu items, pricing, availability, and product categories. We also collect Baker bank account and payout information through our payment processor Stripe for the purpose of disbursing earnings.
From Customers: When a customer registers, we collect their first and last name, email address, city and state, and zip code. When a customer submits an order request, their payment method is collected and saved by Stripe, and a temporary $15 preauthorization is placed on the card to verify it. This preauthorization is a hold, not a charge; it is released promptly after verification, and the card is not charged unless the Baker accepts the order. We do not store full card numbers on our servers.
From All Users: We collect information about how you use the Platform, including pages visited, orders placed, messages sent, and reviews submitted. We may collect device type, browser type, and IP address for security and analytics purposes.
3. How We Use Your Information
We use the information we collect to: (a) operate and improve the Platform; (b) match customers with available Bakers; (c) process payments, place and release card verification preauthorizations, and disburse Baker earnings; (d) send transactional emails including order confirmations, pickup reminders, and account notifications via Resend from noreply@mail.bkdlocal.com; (e) send marketing communications to users who have opted in via our Beehiiv email list; (f) provide AI-assisted reply suggestions to Bakers in the Platform’s messaging feature; (g) detect and prevent fraud; (h) comply with legal obligations; and (i) respond to customer support requests.
4. How We Store Your Data
Your data is stored in Airtable, a cloud-based database service, and on Railway, our hosting provider. Payment information is processed and stored by Stripe, Inc. in accordance with their security standards. Profile photos and menu images are stored via Cloudinary. We retain your data for as long as your account is active. You may request deletion of your account and associated data by contacting hello@bkdlocal.com.
5. How We Share Your Information
We do not sell your personal information. We share information only as follows:
With other users: Baker profile information including name, business name, city, bio, menu items, photos, and availability is visible to all users of the Platform. Customer names (first name and last initial) are visible to Bakers for order management purposes. Customer ratings are visible only to Bakers and are not displayed publicly. A Baker’s pickup address is never displayed publicly; it is shared with a customer only after the Baker accepts that customer’s order, at which point it appears on the customer’s order details and in the order confirmation email.
With service providers: We share data with Stripe (payment processing, card verification preauthorizations, and Baker payouts), Airtable (data storage), Railway (hosting), Cloudinary (image storage), Resend (transactional email), Beehiiv (email marketing), and Anthropic (AI-assisted reply suggestions; message content may be processed by Anthropic’s API to generate suggested replies for Bakers). These providers access only the data necessary to perform their functions and are contractually prohibited from using it for other purposes.
For legal compliance: We may disclose information when required by law or to protect the rights, safety, or property of Bkd Local, our users, or the public.
Business transfers: If Bkd Local is acquired or merges with another entity, your information may be transferred as part of that transaction. We will notify users by email before any such transfer occurs.
6. Email Communications
By creating an account you consent to receive transactional emails related to your account and orders. You may also be added to our Beehiiv marketing list if you opt in. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email. Transactional emails related to active orders cannot be opted out of while an order is pending.
7. Data Security
We use industry-standard security measures including SSL encryption for data in transit and access controls for data at rest. Payment card data is handled exclusively by Stripe and is never stored on Bkd Local servers. No method of transmission or storage is 100% secure. We cannot guarantee the absolute security of your information, but we are committed to protecting it using commercially reasonable means.
8. Your Rights
You have the right to: (a) access the personal information we hold about you; (b) request correction of inaccurate information; (c) request deletion of your account and associated data; (d) opt out of marketing communications at any time; and (e) receive a copy of your data in a portable format upon request. 9. Children’s Privacy
The Platform is intended for users 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected information from a minor, we will delete it promptly.
10. Cookies
We use session cookies to maintain your logged-in state while you use the Platform. We may use analytics tools to understand how users interact with the Platform. You may disable cookies in your browser settings, but doing so may affect your ability to use certain features of the Platform.
11. California Privacy Rights
California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete personal information, and the right not to be discriminated against for exercising privacy rights. 12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the Platform after changes are posted constitutes acceptance of the updated Policy.
13. Governing Law
This Privacy Policy is governed by the laws of the State of Tennessee. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Gibson County, Tennessee.
